These Terms of Use ("Terms") govern your access to and use of kompanya.com ("Kompanya", the "Service"), operated by AGMS Information Technology Inc., Ground Floor, Weber Hotel, Brgy. Jubay, Liloan, Cebu. By creating an account or using the Service you agree to these Terms.

1. The Service

Kompanya is a marketplace that connects job seekers and employers. Kompanya is a venue only: we are not a party to any employment contract formed between users, and we do not guarantee the quality, safety or legality of jobs or candidates.

2. Accounts

  • You must be at least 18 years old to use the Service.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • Adding an email address in account settings is optional but required to recover a forgotten password.

3. Acceptable use

You agree not to:

  • Post false, misleading or fraudulent jobs, gigs, profiles or applications.
  • Post content that is unlawful, discriminatory, defamatory or infringes the rights of others.
  • Collect or harvest other users' data, or use the Service to send spam.
  • Interfere with the operation or security of the Service.

4. Content

You retain ownership of the content you post but grant Kompanya a non-exclusive licence to host and display it for the purpose of operating the Service. We may remove content that violates these Terms.

5. Employer plans and payments

Employers may purchase job post plans as published on the Service. Quotations generated on the platform are formal offers valid for the period stated on the quotation and do not constitute proof of payment. Prices are stated in the site currency configured at the time of issue.

6. Job posting credits

A paid job post is bought for a fixed display period. If you close such a post before that period has elapsed, the unused part of what you paid for it is returned to your account as job posting credit, in the same currency it was paid in. A post closed within the minimum charge period published in your Employer Hub is charged for the whole of that period; beyond it, the charge is calculated in proportion to the days the post was listed. Where a plan included several job posts, what you paid is apportioned equally between them.

Credit is not refundable and has no cash value. It cannot be withdrawn, transferred or exchanged for money, and may only be spent on a future job post on the Service. Credit may be combined with any other payment method; where it does not cover the whole amount, the balance remains payable by that method. Credit does not expire while your account is open, and is forfeited if your account is closed or terminated.

7. Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, AGMS Information Technology Inc. shall not be liable for any indirect, incidental or consequential damages arising from your use of the Service, including dealings between users.

8. Termination

We may suspend or terminate accounts that violate these Terms. You may stop using the Service and request account deletion at any time.

9. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

10. Governing law

These Terms are governed by the laws of the Republic of the Philippines. Venue for disputes shall be the proper courts of Cebu, Philippines.
